The Environment Agency is prosecuting Carluccio's under the Producer Responsibility Obligations 2007, for failing to register as a producer of packaging waste. The legislation requires companies who have an annual turnover in excess of £2 million and who handle in excess of 50 tonnes of packaging per annum to register with the Environment Agency or a compliance scheme.
The case is due to be heard on October 22 at City of Westminster Magistrates Court. Carluccio's could face a fine of £5,000 per offence if found guilty in the magistrates court, or an unlimited fine if the case proceeds to the Crown Court.
Nobody from Carluccio's was available for comment.
